SPRINT 8 CARDIO CHALLENGE
OFFICIAL RULES
1. HOW TO ENTER: NO PURCHASE NECESSARY TO ENTER OR WIN. A PURCHASE WILL NOT IMPROVE YOUR CHANCES OF WINNING. VOID WHERE PROHIBITED. The Sprint 8 Cardio Challenge is sponsored by Johnson Health Tech: Matrix Fitness, 1600 Landmark Drive, Cottage Grove, WI 53527(“Sponsor”) (the “Giveaway Address”).
2. ELIGIBILITY: Participation in the Giveaway by those who are eligible in accordance with these Official Rules will automatically be made when completing photo submissions on Facebook or Instagram during the Entry Period (as defined below) (the “Registration”). Entry is open to all who are 18 years or older at the time of entry and a U.S. resident (the “Eligible Territory”). Participation in any part of the Giveaway constitutes a participant’s agreement to be bound by these Official Rules. Participants agree to be bound by the decisions of Sponsor with respect to this Giveaway and such decisions shall be final.
3. HOW TO ENTER: Between December 1, 2020 8:00 AM CST and January 31st at 11:59 PM CST, 2021 (the “Entry Period”), Individuals who submit a photo will be automatically entered in the Giveaway. All entries submitted become the property of the Sponsor. If for any reason the Giveaway is not capable of being conducted as contemplated in the Official Rules, including if due to technical failures which compromise the administration or integrity of the Giveaway, Sponsor, in its sole discretion, reserves the right to terminate or modify the Giveaway. Sponsor reserves the right to disqualify any entrant who tampers or attempts to tamper with the entry procedure or the Giveaway or violates these Official Rules.
4. GIVEAWAY PRIZE; ODDS. One (1) Prize winners (the “Winners”) will receive the following Prize (the “Prize”): Apple Airpods (Approximate Retail Value $129 (the “Prize”), Sprint 8 towel, (Approximate Retail Value $6.76), Sprint 8 Cardio Protocol, (Approximate Retail Value $19.95), Sprint 8 T-Shirt, (Approximate Retail Value $12.00). Four (4) Prize winners (the “Winners”) will receive the following Prize(s) (the “Prize”): Sprint 8 towel, (Approximate Retail Value $6.76), Sprint 8 Cardio Protocol Book, (Approximate Retail Value $19.95), Sprint 8 T-Shirt, (Approximate Retail Value $12.00) (the “Prize”). No transfer or substitution of prizes permitted except where required by law. If the Prize, or any portion of such prize, becomes unavailable, the Sponsor may award a substitute prize of equal or greater value. Odds of winning depend on the number of individual submissions and eligible entries received in the Giveaway. All expenses, costs and fees not expressly included above are the sole responsibility of Prize Winner. The total number of prizes to be awarded in the Giveaway is five (5) Giveaway Prizes. Following determination of the winner, the prize will be shipped at the Sponsors expense at the most economical rate. Tracking numbers will be provided.
5. WINNER SELECTION AND NOTIFICATION: Tentative Prize winner(s) will be selected in a random drawing to be held on or about February 1, 2021 at 9:00 am (the “Drawing”). The selected entries will be the tentative Prize winners, subject to confirmation by Sponsor of compliance with the Official Rules. Sponsor will use reasonable efforts to notify the tentative Prize winner via private message on social media within fourteen (14) days of the drawing and at that time Sponsor may, at its election, require a tentative Prize winner to complete Sponsor’s Affidavit of Eligibility and Liability and Publicity Release (the “Release”) as a condition to receiving the Prize. The notified person, at his or her discretion, may disclaim a Prize by not claiming such Prize or by not completing and returning to Sponsor the Release within fourteen (14) days and in such case an alternate tentative Prize winner will be selected. This process will be repeated as necessary until such time as a tentative Prize winner completes and returns to Sponsor the Sponsor’s Affidavit of Eligibility and Liability and Publicity Release within fourteen (14) days. At such time, subject to verification by the Giveaway judges, a tentative Prize winner will be deemed the Prize Winner. Except where prohibited by law, the Prize Winner further grants to the Sponsor the right to use the Prize Winner’s name, photograph, voice, likeness and city of residence for purposes of advertising or promoting and publicizing the efforts and activities of the Sponsor and the Giveaway without further consideration and to release his or her name to persons requesting the names of the winners of the Giveaway. Non-compliance or the return of any prize notification as undeliverable may result in disqualification and selection of an alternate winner.
6. NAME OF WINNER: For the name of the Prize Winner, available before March 30th, 2021, send a self-addressed stamped envelope (except where not required by State law) to: Attn: Marketing - Giveaway Winner’s List, Johnson Health Tech, 1600 Landmark Drive, Cottage Grove, WI 53527.
7. RELEASE AND LIMITATIONS OF LIABILITY: BY PARTICIPATING IN THE GIVEAWAY, PARTICIPANTS AGREE TO RELEASE AND HOLD HARMLESS SPONSOR, ITS AFFILIATES, SUBSIDIARIES, ADVERTISING AND PROMOTIONAL AGENCIES, AND ITS AND THEIR OFFICERS, DIRECTORS, EMPLOYEES AND AGENTS (THE “PROMOTION PARTIES”) FROM AND AGAINST ANY CLAIM OR CAUSE OF ACTION ARISING OUT OF PARTICIPATION IN THE GIVEAWAY OR RECEIPT OR USE OF ANY PRIZE, INCLUDING PROPERTY DAMAGE, PERSONAL INJURY OR DEATH. EACH PARTICIPANT FURTHER AGREES THAT IN ANY CAUSE OF ACTION, THE PROMOTION PARTIES’ LIABILITY WILL BE LIMITED TO THE COST OF PARTICIPATING IN THE PROMOTION, AND IN NO EVENT SHALL THE PROMOTION PARTIES BE LIABLE FOR ATTORNEYS’ FEES, PUNITIVE, CONSEQUENTIAL, DIRECT OR INDIRECT DAMAGES AND EACH PARTICIPANT WAIVES THE RIGHT TO CLAIM ANY DAMAGES WHATSOEVER.
8. FURTHER RESTRICTIONS; DISQUALIFICATION. Any and all applicable federal, state, and local taxes and all fees and expenses related to acceptance and/or use of the Prize not specifically stated herein are the sole responsibility of the entrant. Sponsor will not replace any lost or stolen prize. Sponsor is not responsible for the winner’s use of any prize after it has been taken into possession by the prize winner. Incomplete, illegible, corrupted, or untimely entries are void and will be disqualified. Each entry must be submitted by the entrant.
9. GENERAL CONDITIONS. Subject to applicable law, Sponsor reserves the right to change these rules at any time. At the sole discretion of Sponsor, all entries are subject to verification. Sponsor is not responsible for any computer, software, online, Internet or technological malfunctions or for lost, late, stolen, incomplete, illegible, inaccurate, undelivered, delayed, mutilated, postage-due or misdirected mail, correspondence, requests, claims or other errors or problems in connection with or relating to the Giveaway. All entries submitted become the property of the Sponsor and will not be returned. If for any reason the Giveaway is not capable of being conducted as contemplated in the Official Rules, Sponsor may terminate or modify the Giveaway. Sponsor may disqualify any entrant who tampers or attempts to tamper with the entry procedure or the Giveaway or violates these Official Rules. This Giveaway is offered only in the United States and is governed by the laws of the state of Wisconsin.
